Terms of use

1. General

1.1. These terms govern the use of the sanatplace website (the “Site”) and are an agreement between the user and Rasuljon Muminov (the “Operator”).

1.2. The Site is an information platform where artists publish information about their original works, and visitors can view them and contact the artists. The Operator does not sell paintings, is not a party to deals between users, does not accept payments and does not arrange delivery.

1.3. By pressing “Sign in with Telegram” and confirming the sign-in in the Telegram bot, the user confirms that they have read and accept these terms and the Privacy policy. A user who does not agree with them may browse the catalog without signing in, but must not sign in to the Site.

1.4. The personal cabinet may be used from the age of 18, or with the consent of parents or legal guardians.

2. Account

2.1. Signing in is possible only through Telegram: the user confirms the sign-in in our bot. The account is created automatically on the first confirmation. The Site does not ask for passwords, phone numbers or email.

2.2. Access to the account depends on the Telegram account. The user is responsible for its security and for actions taken after signing in from their device.

2.3. The name and username from Telegram are updated on the Site at each sign-in. An account can be deleted on request to the Operator (see Contacts).

3. User roles

• Visitor: browses the catalog and artists' pages without signing in.
• Buyer: a signed-in user who marks works they like, keeps a wishlist and messages artists on the Site.
• Seller (artist): a user whose application has been approved by a moderator; publishes their works and a public profile under the Seller rules.
• Moderator and administrator: representatives of the Operator who review applications and works and manage the catalog.

4. Deals between buyers and artists

4.1. The buyer and the artist agree between themselves on the price, payment method, delivery, timing, returns and other terms of the purchase, in a conversation on the Site or in any other way they choose. The contract of sale is made between them.

4.2. The price on the Site is set by the artist in somoni (TJS) and is for information. Listing a work is not a public offer by the Operator.

4.3. The Operator checks applications and works before publication but does not guarantee the authenticity, authorship or condition of a work, that the photo matches the original, or that the parties will fulfil their obligations. The “Sold” status is set by the artist.

4.4. Before paying, we recommend making sure the work exists (ask for more photos or a video, meet in person) and not sending prepayment to strangers without guarantees.

4.5. The Site is currently free for everyone and charges no commission. If the Operator introduces paid features, payment on the Site or a commission, it will publish a new version of these terms in advance.

5. Prohibited

• passing off other people's works, copies or reproductions as your own originals;
• publishing false information, or illegal, offensive or obscene content;
• using the Site for fraud, spam or collecting other users' data;
• sending insults, threats, advertising or messages unrelated to the works;
• trying to access other people's accounts or the administration area, or disrupting the Site.

6. Moderation and restrictions

6.1. The Operator may reject an application or a work, unpublish a work, change or remove a profile photo, and restrict or delete an account if these terms or the Seller rules are broken, or on a justified complaint. The reason a work was not published is shown to the seller in their cabinet.

6.2. Complaints about works, artists and rights violations are accepted at the addresses on the Contacts & complaints page.

7. Intellectual property

7.1. The rights to the works and their photos belong to the artists. The artist grants the Operator the right to use the photos to the extent described in the Seller rules.

7.2. The Site's name, logo and design belong to the Operator. The Site's materials may not be copied for commercial use without the rights holder's permission.

8. Liability

8.1. The Site is provided “as is”. The Operator tries to keep it running without interruption but is not liable for temporary unavailability, including because of failures of Telegram, hosting or communication networks.

8.2. The Operator is not liable for losses arising from deals and conversations between users, to the extent permitted by the law of the Republic of Tajikistan.

9. Changes and governing law

9.1. The Operator may change these terms. A new version takes effect when it is published on this page; by continuing to use the Site, the user accepts it.

9.2. These terms are governed by the law of the Republic of Tajikistan. Disputes are settled by negotiation and, failing agreement, in the court at the Operator's location, unless the law provides otherwise.
